Employees Compensation Claims Procedures

What to do if an accident happens to your employees …

1. In the event of an employee sustaining injury arising out of and in the course of his / her employment, you should

-           Send the injured employee to the nearest hospital or registered medical practitioner clinic for medical treatment;

-         Complete and send “Form 2/2B” in duplicate to the Labour Department within 14 days of the accident, and forward the same to us for record;
-         When the injured employee recovers and resumes normal work, you should follow the instructions given by the Labour Department and complete all necessary procedures for the assessment of compensation.

2. Please submit the following documents to us:

-           Copy of the completed Form 2/2B, along with the original sick leave certificate(s);

-           Original medical receipt(s);

-           Copy of Hong Kong Identity Card of the injured employee;

-           Original Form 5 and Original Form 7 (if any);

-           Other relevant documents as requested by us (if any).

Motor Claims Procedures

What to do if you face a traffic accident …

1. In the event of a traffic accident, you should

-           Report to the police immediately;

-           Not to discuss or admit legal liability or make payment with any parties;

-           If possible, take photos / videos of the scene before anything is moved;

-         Record important information, e.g. Registration numbers of involved vehicles, exact location of accident, damaged property, witnesses, etc.;

-           Exchange contact and personal details with other drivers, passengers, injured parties;

-           Report the accident to us within 14 days.

2. Please submit the following documents to us:

-           Duly completed original Claim Report Form within the reporting period;

-           Copy of police statements given by you / your passengers with the police case reference number;

-           Copy of the driver’s Hong Kong Identity Card and driving license;

-           Copy of vehicle registration documents;

-           Photographs and details of third party driver and injured persons;

-           Screening breath test report and notice of intended prosecution.

Important Notes:

-           Keep the original copy of all relevant documents for your record;

-           Notify us and / or your intermediaries as soon as possible whenever any prosecution is contemplated / convicted;

-         Immediately forward to us all forms of correspondences from third parties regarding the traffic accident and leave them unanswered;
-         The time bar for an injured party to start a civil action in respect of a claim which causes personal injuries is normally 3 years, whereas in the case of a property damage claim, the time bar is 6 years;
-         Third parties are entitled to lodge claims against you anytime within the abovementioned time bars.

Property Claims Procedures

What to do if you have property damage …

1. In the event of loss of or damage to your property, you should

-           Report to us as soon as possible;

-           Retain all of the affected / damaged property for inspection;

-           Not to conduct any major repair / replacement to the affected / damaged property without our prior written consent;

-           Not to dispose the affected / damaged property without our prior written consent;

-           Carry out remedial measure(s) to avoid further damage to the affected / damaged property;

-           Immediately report to the police in the case of theft / burglary / malicious damage.

2. Please submit the following documents to us:

-           Duly completed original Claim Report Form;

-           Original purchase invoice(s) / past renovation record showing the affected / damaged property;

-           The repair / replacement quotation for the affected/ damaged property;

-           Colour photographs pertaining to the scene and the affected / damaged property;

-           Police report number in case the incident is reported to the police.

Public Liability Claims Procedures

What to do if you get involved in a liability claim …

1. In the event of third party claiming against you, you should

-           Notify your intermediaries or us immediately of any potential claim;

-           Retain the defective part(s), which cause the loss of / damage to third party property or bodily injury of third party;

-           Keep the relevant CCTV footage pertaining to the occurrence of the incident;

-         Not to promise the third party to make good the affected / damaged property in their premises or make payment to the third party or admit liability after the occurrence of this incident without prior written consent from us;
-         Carry out necessary remedial measure(s) to avoid further damage to the third party property and prevent recurrence of similar incident after the occurrence of the loss / damage / injury.

2. Please submit the following documents to us:

-           Duly completed original Claim Report Form;

-         Incident report prepared by the relevant authorized parties (e.g., Building Management) as a proof of the occurrence of the incident;

-           Witness’s statements, if any;

-           Copy of the police report, if applicable;

-           The third party's name, Hong Kong Identity Card No., telephone number and address, if available;

-         Colour photographs pertaining to the scene of the incident, the injury of the third party and / or damage to the third party property;

-           CCTV footage pertaining to the occurrence of the incident;

-         All correspondences from the third party and / or the representative(s) of the third party shall be forwarded to us unanswered immediately;

-           Other relevant supporting documents regarding the incident, if any.

Marine Cargo Claims Procedures

What to do if you have a marine cargo claim …

1. In the event of loss of or damage to your marine cargo, you should

-           Immediately notify the loss / damage to the Survey Agent or Settling Agent named in the Policy Schedule or us;

-         File a claim in writing to the carriers, forwarders, bailees or other concerned parties for any missing or damaged packages within the time limit mentioned in the shipping document, in general, 3 days for sea cargo and 14 days for air cargo;

-           Take reasonable measures to avert or minimize further loss to the remaining cargo;

-           Take proper care of the damaged cargo and keep any salvage.

2. Please submit the following documents to us:

-           Duly completed original Claim Report Form;

-           Original policy or certificate of insurance;

-           Shipping invoices and packing list;

-           Original bills of lading and / or other contract of carriage;

-           Survey report or other documentary evidence to show the extent of the loss or damage (e.g. Exception list and Damage report);

-           Copy of correspondence exchange with the carriers and other parties regarding their liability for the loss or damage;

-           Colour photographs;

-           Loading account and weight notes at the final destination, in the case of missing cargo.

Forwarder Liability Claims Procedures

What to do if you have a forwarder's liability claim …

1. In the event of losses / damage / bodily injury, you should

-           Immediately notify us of the loss / damage;

-           Report the incident to the relevant authorities, where appropriate;

-           Not to negotiate, admit or settle any liability to a third party, and not to waive any rights against other parties;

-           Make detailed records of the conditions of the damaged cargo;

-           File a claim in writing to other liable parties.

2. Please submit the following documents to us:

-           Duly completed original Claim Report Form;

-           Incident report including the circumstances of the incident;

-           Colour photographs;

-           Copy of contract of carriage involved (e.g. Master Bills of lading and House Bills of lading with its terms and conditions);

-           Copy of the cargo delivery receipt and other relevant documents.
